MEMBERSHIP TERMS & CONDITIONS – WAIVER & RELEASE Acknowledgement of Risks, Injury & Obligations I acknowledge that the activity I am to undertake is a dangerous activity and that by participating in it I am expected to certain risks. I acknowledge and understand that whilst participating in such activity • I may be injured, physically or mentally, or may die; • My personal property may be lost or damaged; • Other person participating in such activity may cause me injury or may damage my property • I may cause injury to other persons or damage their property • The conditions in which the activity is conducted may vary without warning • I may be injured or die or suffer damage to my property as a result of the negligence or breach of contract of The Fit Pit LLC • There may be no or inadequate facilities for treatment or transport of if I am injured • I assume the risk of and responsibility for any injury, death or property damage resulting from my participation in the activity. Release and Indemnity I participate in the activity at my sole risk and responsibility. I release, indemnify and hold harmless The Fit Pit LLC, its servants and agents, from and against all and any actions or claims which may be made by me or on my behalf or by other parties for or in respect of or arising out of any injury, loss, damage or death caused to me or my property whether by negligence, breach of contract or in any way whatsoever. Administration • Appropriate covered footwear & a shirt must be worn at all times while in the gym facility. • Memberships are not refundable or transferable. • All weights and equipment must be put back after use • Photo ID cards (student ID or driver’s license) must be carried and shown upon request. • Shared gym access with a non-member will result in forfeiture of membership effective immediately • Each member must respect other gym users and behave in an appropriate manner at all times. • The Gym Staff reserves the right to rescind the rights of members not complying with the terms and conditions of the membership • Anyone under the age of 16 must be accompanied by an adult at all times within the gym. Rules & Regulations 1. Members must be 16 years of age to use the facility unsupervised. Members under the age of 16 must be directly supervised by a responsible adult at all times, who also must be a member. Members may not bring children into the gym area. 2. The Fit Pit is not responsible for lost or stolen items. 3. No member shall allow any other party to utilize their key card for access into the gym. 4. No member shall allow any other party into the facility unless they are an active member. 5. No member shall remove any equipment, fixtures, or furniture at any time for any reason. 6. No member shall use the facility for any purpose other than its intended use as a fitness center. 7. No member shall perform personal training services without the express written consent of The Fit Pit and the client and trainer must be an active member of the gym. 8. No member shall use any equipment for any purpose other than its intended use. 9. No member shall behave in any manner that is a distracting to other members. 10. No member shall utilize radio and music producing devices other than personal devices or the equipment provided by The Fit Pit. 11. No member shall harass any other member. 12. No soliciting merchandise or services ( Solicit- to ask earnestly; to invite) 13. No loitering ( Loiter- to hang about; to linger) 14. Members are responsible for returning all weights to designated weight stations. 15. No use of profanity. EVERY MEMBER MUST SWIPE THEIR CARD! Violations of any of the above detailed violations will result in immediate and permanent cancellation of their membership and if appropriate, criminal prosecution. Thanks
